HB 1 Is Up For Floor Discussion today

House Bill 01 to bring FOIA to the Delaware General Assembly is on the agenda for House Floor discussion today, January 29, 2009.

WHAT: Support Passage of HB01
WHERE: Leg Hall, Dover
WHEN: 12:30 gather in the cafeteria at Leg Hall, 1:00ish move upstairs to talk to Representatives on the floor or in their offices; 2:00ish move up to House Galley to observe the proceedings.

Where your OOGA green tee shirts if you have one.

If you can’t make it to Leg Hall today please call your Representative and ask him/her to vote for a CLEAN HB01, don’t junk it up with amendments that will gut the bill.

    Schwartzkopf does have a point on his email concern, but his reasoning is way off (costs).

    What I think is a valid concern is that there are consituents that will only use email, but convey personal info (such as health records, financial items, etc) to their rep/sen that should not be exposed to FOIA. There needs to be a method to extract those specific scenarios, else risk breaking down a viable avenue for constituent-rep/sen communication.

    Constituents must be advised NOT to include such personal info in an email.

    They should be directed to send such data through the U.S. Post Office or to hand deliver.

    The state has a secure email plug-in that would take care of the FOIA. Although this can be a bit much for the technology-challenged, it is an option

    Part of FOIA compliance is to review the info before sending it to the requester to make sure that confidential data (personal or business) is not included in the data package. But confidential data from constituents should be exempt from this.

    Anyone hear an update on the debate yet?

    Discussed baloney. Dissed to March 18th. You know — to allow time for the amendments to be reviewed. My public service announcement for today.

    Actually no meat. Went to immediate table until March, when brought forward. I gotta get me one of those green shirts.

    Here is the committee report on this bill and what probably got it deferred to March.

    That doesn’t protect it from FOIA. Correspondence is correspondence, whether e-mailed, faxed or scribbled in crayon on the back of a Snickers wrapper.

    The committee raised concerns regarding financial implementation and possible needs for amendments. The committee raised concerns about constituent safety with regard to what information should be considered public record. The committee felt that the issues accompanying this bill would best be approached in an open debate on the chamber floor.

    So this is the committee report? All of it?
