House Dems Calling for 14th Amendment Remedy
Who is charged with protecting America from domestic terrorists hell bent on trashing our economy? If that job falls to the President of the United States, then this is looking to be the only likely outcome of the debt ceiling “crisis.”
WASHINGTON (AP) — House Democrats said Wednesday that President Barack Obama should invoke a little-known constitutional provision to prevent the nation from going into default if Congress fails to come up with a plan to raise the debt ceiling.
Rep. James Clyburn of South Carolina, a member of the Democratic leadership, said he told fellow Democrats that Obama should both veto any House GOP plan for a short-term extension of the debt ceiling and invoke the 14th amendment, which says that the validity of the nation’s public debt “shall not be questioned.”
Obama gave up defending and protecting the Constitution of the United States on January 20, 2009.
The Constitution also says congress must approve all spending. I DO like how we now have yet another er group. the 14thers.
I’ve personally given up. This country is stuck with these sicko’s (the republicans) because we (the collective we… not me) voted for them. People act shocked that they arent creating jobs and only focusing on bringing down Obama…. they only said thats all they were going to do up until 4 weeks before the 2010 elections…. then started talking about “merica and Jobs”
Trump has it exactly right. The dumbasses who trundle into the voting booths will forget everyone’s name except Obama and vote against him because thats what the blonde with big boobs on the talky picture box tells them to do. Im convinced Obama won because the same idiots were swept up in the media-created hype about him. It’s evident people didnt really know who they were voting for because of everyone who feels “betrayed” now….. He’s done exactly what he said he would do and if you cant see it, you should be following horses in a parade.
What i HOPE happens is, the teabaggers stand firm.. feet planted in the shit-swamp they have made… and Boner has to take the few sane-republicans plus all the Dems to pass a bill… WHICH the senate will be able to pass. IF if can get past a Teabagger McConnel backed fillibuster… which it wont. luckily, the hellstorm that comes from default will be able to be totally blamed on the senate GOP. The House GOP who DID vote for it will be sacrificed by the Teahadis for a bunch of Chrissy the Witch clones who will in turn lose to democrats…. election results that the Teabaggers will surely blame on Acorn and the Black Panthers… notice how even in my best case scenario we default. What should happen in in the case of a default is, all the troops come right home and all tax subsidies to everyone end.
what WILL happen is Planned Parenthood, Social security, Medicaid, food stamps, Americorps, Pell Grants and …. let’s say FEMA get completely de-funded.. by the Teahadis, but Obama gets blamed for it (and it will work) in 2012.
go america.
btw, A1 please come up with a new line. it’s as old and tired as ass holes like me continuing to ask you to get a new line
Socialistic Ben is now called Nihilistic Ben.
whatever 🙂
I say PUSH THE BUTTON-END MY MISERY!
House Republicans prevent Obama from increasing Medicare eligibility age.
Erickson calls Boehner’s plan ‘crackpot’, credits Reid with Senate failure of their other crackpot plan.
McCain rips conservatives on Senate floor.
My cup runneth over.
The Constitution also says congress must approve all spending. I DO like how we now have yet another er group. the 14thers.
The spending was already approved by Congress. The question is whether the bill, for spending which was already approved, will be paid.
Reid is a jackass. How he was ever ELECTED is beyond my comprehension, but Nevada is a wacko state. Boehner IS a crackpot, but he knows the debt ceiling must be raised in order for our government to prevent chaos, but his ass is over a barrel & the dumb teabaggers (see Republican David’s idiocy regarding the SS IOUs, for example) haven’t got a clue how our government or our economy actually WORKS.
I’ll be happy if our economy doesn’t implode.
@JM. That’s an interesting argument. I don’t think it’ll go far given our right-leaning SCOTUS.
I’m certainly not a lawyer, but I’d present this argument if I were a “conservative” who wanted to fight a 14th Amendment action by Obama:
1. A previous Congress approved the initial spending (funding wars, purchasing equipment, whatever.)
2. The present Congress has the responsibility to pay or NOT pay for these expenditures, and all other government expenses.
3. You argue that the SPENDING was already approved. That’s true, but it’s akin to me saying that all expenditures charged to my credit card were “approved” before my employer cut my pay in half and told me I was lucky he didn’t ship my job off to China or some third world shit hole. (pretty sure the Chief Justice would not take kindly to my language, but FUCK him–he’s a right wing d-bag.)
Bottom line–I’d like to see Obama do SOMETHING Presidential, something that shows leadership & COMMAND of a situation. I voted for the guy & he’s been a colossal disappointment to virtually everyone.
Who would have standing to make your “argument” (such as it is)?
The Fourteenth Amendment, Section 4, reads: The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned.
JM–I’m pretty sure the conservative SCOTUS would approve a bunch of R congressmen/women as having “standing”.
FWIW, I agree with your position–but the 14th Amendment would create a constitutional conundrum.
*the 14th Amendment, as applied to this particular situation.*
The forum software would not allow me to edit my comment for some reason. Apologies to all.
anon40, usually i would agree with you, but Kennedy is a pro-business republican. He knows the implications for his stocks and will side with money. 4 of them are sane. the other 4 hate america. (lets play who’s who)
I think it should be inherent when a budget is passed that the debt ceiling is raised to pay for it.
If there was an insurrection or rebellion, you know they’d find the money to suppress it, default or not.
“I think it should be inherent when a budget is passed that the debt ceiling is raised to pay for it.”
There you go again with your left wing logic and reason! Don’t you know it’s all about emotions and misinformation these days?
/sarcasm
Better yet, if a government is “truly run” like a business, when a budget gets passed, instead of borrowing, the revenue stream is raised to pay for any difference thereby making make it balances….
Say, like tax capital gains until Iraq, Afghanistan, or the Pharmaceutical Income Supplimentary Act, commonly known as the Medicare Prescription Act…. are paid for.
This whole idea that “if a government is “truly run” like a business” it wouldn’t borrow money is profoundly ill-informed. Most businesses borrow money routinely, and suggesting that governments shouldn’t borrow money is foolish.
Invoke the 14Th amendment and argue about it’s use later. When is this President going to stop kissing Repuk’s asses and lead?
Reid ought to send over a clean debt increase so it’s on the table. Demand a clean debt increase, and tell Repubs to save their bullshit for the budget debate.
Gas man,
where the hell in this post am i supposed to tell you support this tactic?
You have to look at the whole oeuvre. You can’t proof text one post. That’s bush league.
But to put it on a lower shelf: I’m a Keynesian. I’d favor the 14th announced to raise the debt limit too $200 bazillion. Then without missing a beat, a second announcement of a huge federal jobs program.
All that was pretty clear to anyone paying attention.
I only look for the posts where Cassandra rubs your nose where you peed.
Thanks for the clarity. Your boy carper is riding the Boner train for the record.
“Your boy carper is riding the Boner train for the record.”
If you know something, a blog is good place to spill it.
The political problem with Obama invoking the 14th amendment is that the House RepublicanÂs will then commence impeachmenÂt proceedingÂs against Obama during 2012, the election year. The RepublicanÂs will vote lockstep to impeach him, but the Senate will not vote to remove him from office. NevertheleÂss, the GOP will have a field day politicallÂy w/ the impeachmenÂt proceedingÂs in 2012. The fact that the nation will, otherwise, be in default might be sufficient reason for Obama to go ahead and invoke the 14th amendment (it would be for me). But no Democrat should think that invoking it provides a safe pass to Obama politicallÂy.
if your crew wasn’t tied up on Huffpo and TPM all day you’d have found it earlier. Feel free to link away though 🙂
A July 20th post? C’Mon man. I’m not trying to tell you how to run your blog, but ambush Carper with that “a one or two month debt ceiling extension seems like a good idea” quote on video coming gout of his Citibank office.
That would be link worthy. Especially if you could get one of his goons to punch you.
What’s *really* fun about this is that I don’t even have to go over there to point out how wrong DV is — Carper wants the Catfood Commission plan.
Sheesh.
Dang, fine, fine you got me. But again in my defense I’m really just over here for the Jerry Springer stuff. Pardon me if I miss some stuff.
and additionally, even your own contributors don’t read your garbage.
see above post from Ms. Warwick as proof

thanks for engaging me. I was beginning to feel hurt

If you are admitting to being a troll you will not be around here for long.
oh for god’s sake, not to cause it, between you and Obama’s Kool-aid carriers.
Donviti out!

Actually, not: http://www.tnr.com/article/politics/92884/supreme-court-obama-debt-ceiling
“As Bill Clinton, another former professor of constitutional law, recently declared, if he were president, he would invoke the Fourteenth Amendment to raise the debt ceiling ‘without hesitation, and force the courts to stop me.’ There’s a good chance they wouldn’t.”
