Delaware Republicans called the ruling a victory for democracy.

A victory for democracy that the GOP will appeal. LOL. Seriously, the GOP is appealing a decision that they call a victory for democracy, because I suppose they are against democracy. I guess they did not think through the PR aspect of that.

The reason for the appeal?

However GOP Chairman John Fluharty called into question one ballot in particular that went in McKenna’s favor that they consider too unclear – and they intend to challenge the decision.

So you are appealing to disenfranchise a voter so that your guy can win by 1 vote. Yeah, that is anti-democratic. No wonder you are appealing that victory for democracy.

So, notwithstanding Fluharty’s appeal, what happens now?

If [the election results (a tie) are] certified [by the Department of Elections,] the position will be declared vacant – awaiting an appointment from Governor Jack Markell. […] There was no word from the Governor’s office on who would be appointed – although McKenna – who has held the position since 2003 – is a strong possibility.

McKenna is the Democratic incumbent, and there is that old saying that ties go to the incumbent. But I do admit McKenna getting appointed to the position after her reelection campaign produces an official and certified tie does not leave a good taste in my mouth. Perhaps the Governor could appoint someone else. Further, Delaware law in this regard does not seem fair. An election that ends in a tie should not end in a gubernatorial appointment. It should lead to a new special election.
