    Garland is a great judge on the merits. I think Hillary should appoint him on the merits if she wins and lets get this over with. The man has a stellar record and is the most qualified to serve. You can still tell Grassley to go……!! The R’s know it too.

    Eh, Garland is good enough, but if the Dems win the senate back, Obama should pull the nomination before they have a chance to push through a vote, and site the Mitch rule about letting the next president pick the Justice. Anything to twist the knife in those asshats. President-elect Clinton could even float names like Andy Cohen or Huma Abedin, just to make the rats squirm.

    If I were Hillary I would welcome a lame duck confirmation. Gets the issue out of the way after the election…if she needs to appoint a justice, any political capital she has is going to be swallowed by spending her first 100 days getting a justice confirmed.

    Marco, The GOP has already said that Clinton begins day 1 with zero political capital no matter what. Everything is going to be a fight, so there is no point in giving any ground on anything.

    The guy is eminently qualified and she wont be pouring gas on the flames of the hard cores on the right. Hill will score some early points on the Hill (pun intended) and get a solid Justice on the bench.

  8. If you’re gonna expend political capital, it might as well be on selecting a Supreme Court justice, especially considering the stakes with this appointment. If Clinton suspects that Garland could do to the court’s liberal wing what Souter did to the conservative wing, I’d just as soon she pick someone who is, say, likely to overturn Citizens United and restore the portions of the Voting Rights Act that this court threw into the trash.

    He’s also older than the typical nominee.

    If Hillary really wants to make an impact, she should appoint someone like Jane Kelly or Amy Klobuchar.
    I’d love to see that nomination fight.

    My vote is for Bryan Stevenson. It’s been a while since there has been an activist on the court (Marshall?). He would provide some much-needed perspective on the impact that the rulings have on the ground.
