News Journal Finally Reports Walker Job…Leaves A Few Key Things Out.
Well, the story was broken here at DL, and it will remain an open question as to whether the so-called ‘paper of record’ would have even covered it if we hadn’t. At least, they finally have covered it. The story, which is a good one, raises as many questions as it answers. Oh, and it leaves out one of the key elements of the whole stinkin’ mess: Walker getting the job with an agency under the purview of the state police after carrying the cops’ water in burying the death penalty bill in her committee. Under the approving eye of former state cop and current Speaker Pete Schwartzkopf.
The questions revolve around how she got the job. First, read these excerpts from the News-Journal article…

The real question isn’t “Do people deserve to die for the crimes they’ve committed?”, it’s “Do we deserve to kill?”
General Assembly Post-Game Wrap-Up: Week of March 17-19, 2015
That was quite the dust-up between Sen. Karen Peterson and Speaker Pete Schwartzkopf this week. The argument? Why won’t Schwartzkopf allow a floor vote on legislation eliminating the death penalty? Both legislators make legitimate points.
Pete Schwartzkopf by and large does control the fate of the bill. As Speaker, he not only decides what committee receives the bill, he determines the members of the committees. Put the bill in a committee in which the majority does not support death penalty repeal, and the bill isn’t coming out unless petitioned out. Going against the Speaker to petition a bill out has its own set of perils. So Peterson is correct there. Pete has taken steps to stop the bill, his protestations to the contrary notwithstanding.
However, Schwartzkopf has offered a compromise:
Schwartzkopf has said that he would oppose any repeal legislation that did not include exemptions for those inmates convicted of killing members of law enforcement, including correctional officers.
Not including those exemptions would endanger every correctional officer working in the state’s prisons, he said. He added that he offered amendments to repeal legislation last year, but those requests “fell on deaf ears.”
He said that compromise is needed on the bill. Peterson, he said, is not willing to compromise.
“This building is bigger than one bill,” Schwartzkopf said.
This raises two questions: (1) Would Schwartzkopf take steps to ensure the bill’s consideration if this compromise was accepted; and (2) is it worth it to have a repeal bill with these exceptions?
Delaware Political Weekly, Or An Approximation Thereof: August 16-22, 2014
This article got lost in the Chip Flowers Implosion, Version 4.0, but it shouldn’t have. House D’s facing primary challenges sending out thinly-veiled campaign lit on the public’s dime. A practice that was discontinued under Speaker Gilligan (Terry Spence was the Godfather of this practice), but reinstated by Speaker Schwartzkopf just in time for the primaries. Now here’s the rest of the story. Complaints regarding this practice were filed with Elaine Manlove of the State Department of Elections. She determined that she had no legal jurisdiction over the complaints, that they did not technically violate state law, and referred them to…The House Ethics Committee. Did I mention that the House Ethics Committee is chaired by Valerie Longhurst, one of the two legislators who it’s been confirmed have sent out these mailers on the taxpayers’ dime? Now, that’s the Delaware Way.
House Incumbents Spending Taxpayer $$’s To Fend Off Primary Challengers?
It sure looks that way. Both Valerie Longhurst and Dennis E. Williams have sent out official House correspondence to their districts that are little more than taxpayer-funded campaign pieces. There may well be others who have done the same.
The supposed deniability comes in that these are allegedly legislative updates to constituents. They are sent on their personal House letterhead, in House envelopes, and likely through state mail. And they are prepared in-house by state employees on state time. They tout the alleged accomplishments of the legislators, and, as campaign pieces are prone to do, try to mislead voters on issues where the incumbents are vulnerable. Oh, and so far, they’ve only been sent out by incumbent House members facing primaries.
When I worked in the Senate, we were forbidden from doing this. During the brief time that I worked for the House, then-Speaker Terry Spence allowed us to send such mailings. Of course, it’s likely not coincidence that this policy was set during the election season that the Rethugs were desperately trying to hold onto their majority, and if they did it, he had to let us do it. Truth be told, most of July and August were spent on preparing and sending these mailings.
Only one person can authorize such mailings: The Speaker of the House. It’s likely legal, as the General Assembly routinely exempts itself from laws that apply to everyone else. In fact, apparently it’s technically legal to send out these sorts of mailings up to 35 days prior to an election. But I submit that it’s a wasteful misuse of taxpayer funds.
Breaking News: Delaware House Leadership Team A Team No More
According to literally dozens of sources, Speaker of the House Pete Schwartzkopf and House Majority Leader Valerie Longhurst are no longer allies, to put it mildly. In fact, they’ve had a major falling-out.
Their ‘breakup’ is the talk of Legislative Hall, and it could impact legislative deliberations during the final month of session.
You will recall that, when running for Speaker, Schwartzkopf insisted that he and Longhurst were running as a team, and that it was either both of them or neither of them. It’s the only way that Longhurst could have been elected Majority Leader. By a narrow margin, it turned out to be both of them.
I’ll be right upfront and once again tell you that I dislike Val Longhurst intensely. She has proven that she takes delight in intimidating people and in exercising power over anyone who gets in her way. I will also tell you that she is perhaps the most universally reviled legislative leader with whom I’ve come in contact. Joe Petrilli, also a former House Majority Leader, albeit on the R side, was the previous champion, IMHO. She is despised by many staff people and by many of her colleagues in both the House and the Senate.
While I don’t know why they’ve finally stopped working together, I have to think that Speaker Schwartzkopf, if he wanted to remain Speaker Schwartzkopf next session, recognized the need to jettison the toxic Longhurst.

Delaware General Assembly Pre-Game Show: Tues., January 14, 2014
The 2nd Session of the 147th General Assembly begins today. For newbies, or for those who forget easily, here’s what you need to know. Each legislative term lasts two years, from election to election. The 147th General Assembly runs until Election Day. Since this is the second year of the Assembly, all legislation that was in play on July 1, 2013 remains in play today. Of course, that doesn’t even consider new bills, new nominees, new controversy and, of course, new snark from Yours Truly.
The General Assembly meets for three weeks in January, breaks for six weeks for Joint Finance Committee hearings until mid-March, meets until Easter, breaks for two weeks, meets until around Memorial Day, breaks for two weeks (this is usually when the fiscal bills are finalized), and then meets until the early hours of July 1. But that’s getting ahead of ourselves.
This can and should be a busy and productive January session. It WILL be a contentious session. Here’s just some of the stuff that likely will be considered during January….:
General Assembly Post-Game Wrap-Up/Pre-Game Show: Tues., June 25, 2013
On the subject of Jack Markell’s tactics, when it comes to state employees, he needs an intervention. Which the House D’s, who have bottled up legislation giving state employees a voice on the…State Employees’ Benefits Committee, seem prepared to offer him. Rather than let SB 21, which would give state employees two seats on the committee, come to a vote, the House has announced a ‘compromise’. Rather than just pass the bill, which I have no doubt would pass, or even let it out of committee, well, let’s let mealy-mouthed Valerie Longhurst spell out the ‘compromise’. Direct from a House of Reps press release:
House Majority Leader Rep. Valerie Longhurst, who chairs the Administration Committee, and Senate Bill 21 sponsor Rep. Larry Mitchell worked with union officials last week to reach a general compromise on the measure and will iron out details of an amendment during the legislative break.
“We know that the unions really want this bill to move forward, but we know there is opposition from the administration too,” said Rep. Longhurst, D-Bear. “There also is a good amount of support within our own caucus for the bill, so I have committed to Rep. Mitchell and the unions that we will work out an agreement during the break and come back in January, get the bill released from committee and put it on the floor for a full House vote.”
Allow moi to translate: “We’re gonna stick with the Governor’s anti-employee approach until we totally have to cave to our members.” I mean, what kind of ‘compromise’ is Governor Walker Markell willing to accept in January that he couldn’t accept today? One member instead of two? He’s already got the votes to outvote state employees on the committee if it comes to that. He simply doesn’t even want them to have a seat at the table. And he’s got Schwartzkopf and Longhurst running interference for him. Even though they’re supposed to lead a caucus that wants this bill.
General Assembly Post-Game Wrap-Up/Pre-Game Show: Tues., May 14, 2013
While we were busy celebrating the passage and signing into law of Delaware’s Marriage Equality Act, the House effectively killed off legislation providing a modest hike in Delaware’s minimum wage. Make no mistake: the killing of SB 6 was deliberate and planned, and the co-conspirators were all Democrats: Speaker Pete Schwartzkopf, Rep. Bryon Short, and Gov. Jack Markell.
Here’s how it happened. After bargaining in what he thought was good faith with Gov. Walker Markell, Sen. Robert Marshall agreed to amendments that significantly reduced the impact of SB 6. Specifically, he agreed to push back the effective date, to decouple subsequent rate increases from the rate of inflation, and to lower the amount of the increase. Markell praised the eviscerated finished product, and said he could support the bill. Which was the last ‘support’ he provided. And Speaker Pete got the memo loud and clear: Kill the bill!
And he did. How? By assigning it to the House Business Lapdog Committee, aka the House Economic Development/Banking/Insurance/Commerce Committee, instead of to the House Labor Committee. Chaired by Rep. Bryon Short. You may recall that this is precisely the same tactic that former Speaker Bob Gilligan employed when Markell wanted him to kill the bill last session. And, for the second straight session, Short did not disappoint. SB 6 was passed in the Senate on March 21. It did not receive its hearing in the committee until May 8, and that was deliberate. Short allowed the bill to languish until the last day that, according to House rules, it had to be considered in committee. Many of you are aware of the full-court press opposition led by the respective Chambers of Commerce in the past two weeks. By delaying consideration of the bill, the committee chair enabled that campaign to have optimal effect. To the point where empty tabula rasas like Andria Bennett were reciting Chamber talking points verbatim in opposition to as Democratic a bill as you’ll ever find.
Gov. Markell demonstrated some slickness here. By saying that he would sign SB 6, he eliminates any political stigma that Democrats would attach to him in a future run for political office for publicly opposing a minimum wage increase. And he gets Pete and his DLC house cronies to kill the bill. Just like he did last year. Just remember, Markell’s fingerprints are all over this. Cut’n save.

Delaware General Assembly Pre-Session Show: Tuesday, January 8, 2012
2013 has all the makings of the most momentous year in recent legislative memory. The House and Senate have both undergone major institutional and leadership changes. More progressives now serve in Dover than before.
A pro-business governor with aspirations for higher office must decide both what’s best for the state and what’s best for his political future. A host of important issues await, including, of course, Delaware’s economic condition.
THE GENERAL ASSEMBLY FOR NEWBIES
The Delaware State Senate has 21 members, currently 13 D’s and 8 R’s. The President Pro-Tempore leads the Senate, although the Lieutenant Governor often, but not always, presides over the senate sessions as a non-voting member. Here is a list of the Senate members.
The House of Representatives has 41 members, currently 27 D’s, 14 R’s. The Speaker of the House presides over the body. You can find the House membership here.
The General Assembly is in session from the second Tuesday in January through June 30 each year. The Senate often returns for a special session in the fall to consider nominations.
The General Assembly breaks for six weeks at the end of January for Joint Finance Committee (budget) hearings and meetings. There is another 2-week break around Easter, and an additional week’s break around Memorial Day. The Memorial Day break often enables the ‘money’ committees to finish work on marking up the budget.The typical General Assembly meets in session about 50 days a year.
And we are just getting started.
Schwartzkopf To Announce Re-Election Campaign
House Majority Leader Rep. Pete Schwartzkopf will formally kickoff his campaign for the 14th District House seat on Wednesday, August 1. Come on down, enjoy a nice day at the beach, and be part of Pete’s reelection effort. He is currently being opposed by some teabagger Libertarian, as the GOP doesn’t have its sh*t together on this side of the county.
