Anytime a Capano loses a court case, an angel gets its wings.

Well, the other day, an angel got $7.5 million worth of wings as The Delaware Supreme Court reversed a lower court’s decision (pdf) that said New Castle County had to pay Albert Vietri and Joseph Capano Sr. for losses when they built their hotel too freaking big and NCCo said, “No way, Jose” and shut the hotel down.

    This morning, when I heard this on the radio, I started thinking back to the absolute brazeness of the builders scheme to flat out ignore the building described on the building permit.

    I think it would have worked if Tom Capano had not recently killed Anne Marie Fahey.

    If I read the stories in the NJ correctly it seemed that Capano and his partner submitted a fake letter to a bank about water supply to obtain a loan . Where was our US Attorney on this one nailing Freeberry for the same charge. No she just failed to reveal a loan not falsify a letter.

    My Lord, the stars must be in alignment….. a Delaware Court upholding a developer’s RESPONSIBILITY to abide by the rules and NOT let them treat the UDC like it was written on an Etch-a-Sketch! “See kids, there really is a Santa Claus!”
    I typically rank among Tom and Sherry’s greatest detractors, BUT, regardless of their motivation, they did the right thing in this circumstance. Vietri and Capano clearly crossed them in some way and T & S pulled out the rule book and Coons stood by it.
    By the way, Joe and Mario are the other end of the Capano clan. Don’t quote me on this, but I think they were first or second cousins to Louis Sr., Tom and Louis’s father……. Somebody needs to check the lineage.

    That story was news when I lived in Delaware, and I moved away in mid 2002. Did the hotel ever open?
