COURTS WATCH: Delaware Judge, Leo E. Strine, orders compromise in KFC franchisee dispute & finds “Double Down” Sandwich Disgusting

A Delaware judge has ruled that KFC and its franchisees must cooperate on approving advertising strategies and that the “Double Down” sandwich is a “culinary clusterfuck.”

Judge Leo E. Strine Jr. issued the 65-page ruling Monday in the Delaware Court of Chancery.

The franchisees argued in the non-jury trial that they had authority to develop advertising plans as well as to modify those offered by KFC, while KFC held it had sole control over advertising strategy. Strine’s ruling on the “Double Down” came as an aside to his adjudication of the advertising dispute. It read in part, “I mean, really KFC..What the fuck? That shit is disgusting. Just look at the thing.”

Strine also observed, “…and would it kill you to clean the fucking bathroom once in a while?”

    You have to have sat in Stine’s courtroom or at least read through a few transcripts to really appreciate this. Strine is always alluding to the finer points of Delaware culinary experiences in lawyerly confabs around his bench.
