Kathy McGuiness Still Convicted, Still Corrupt

It is only news to the convicted state auditor that she is convicted.  Everybody else got the news a few months ago.

The convicted state auditor had been going around saying that she isn’t Double-Secret-Convicted because a judge didn’t say so. I expect she have some other nonsensical rationalization now.

Democrats from both chambers of the Delaware legislature renewed their calls for Governor John Carney to remove McGuiness, now that the appeal was heard.

Pete was unavailable for comment while dealing with a family emergency. *shrug*

Has John Carney fired her yet?

    I haven’t followed this, so someone correct me if I’m wrong — does this mean that structuring contracts to circumvent the clear intent of the law is fine-‘n’-dandy with the Delaware judiciary?

      The law on structuring apparently needs to be tightened and clarified. Sounds like a job for an up and coming legislator who wants a higher profile.

    Just finished reading the full opinion.

    On the Structuring, the original My Campaign Group contract was executed properly below the limit at the time ($50k) and only went over near the end.

    The court notes that the Chief of Staff arranging the last 2 months of payments to MyCG was “inexperienced” and while potentially “politically savvy” he “lacked any degree of reasonable sophistication as to the inner workings of the States accounting procedure.”

    Describing the situation as “a comedy of errors and not criminal conduct” Carpenter grants the motion of acquittal for the charge.

      WTF? Now every agency will keep an “unsophisticated” person on staff to carry out their criminal misdeeds.

        We noted throughout the trial this was a very weak charge. And the State didn’t do itself any favors completely misreading the original documents they had.

          Per my original comment, that makes it sound like the state judiciary is OK with contracts structured to follow the letter of the law but not the intent.

          So I agree with puck, the law should be tightened if the intent is valid.

    Really this stems from the State’s initial mistake assuming certain things based on numbers in a spreadsheet that turned out not to reflect what actually happened.

    Even Hall of Famers go 0 for 4 with 2 strikeouts some games…. lol

    At some point a democrat I no longer appreciate must have given McGuiness their email list because I ended up on hers. It was annoying until it became comical when I read this news and her “did you see the court news – I won” email that was about her Medicaid case on the same day.

  7. OK. The convictions have been upheld on two charges.

    What will be John’s excuse for not initiating proceedings to remove her from office now?

    He’s always waiting for something. Godot, maybe?

    Lol. I feel like I’ve been very clear about this. I do not believe she is an underdog. I find her repugnant based on her naked political ambition and the way she managed the office. Her treatment of her employees is reprehensible.

    I’m voting for her to fuck with Carney and the party because they deserve it.

    While it appears the auditor has been convicted now of two misdemeanors and would seem extremely vulnerable in the Sept. 13 Primary, I am reminded of some old posts- “You can’t beat somebody with nobody”. The endorsed Democratic candidate is nowhere to be seen or heard. She has no presence on social media (no Facebook posts of her knocking on doors or speaking to groups). As a matter of fact, she was scheduled to speak to the Eastern Sussex Democrats last week. The incumbent was also to appear and many people attended to see and hear the alternative. Ms. York was a No Show.

    Unless the endorsed candidate has some well-laid plans for mass mailings in the next 10 days, the Party is once again going to be embarrassed by its endorsed Primary candidate losing. The Party endorsed John Carney for Governor and Gene Reed for Insurance Commissioner in 2008. They lost to Jack Markell and Karen Weldin Stewart). It endorsed Mitch Crane against KWS in 2012. He lost. They then decided not to endorse again- until this year. Why endorse a candidate and then DO NOTHING for them?

    I was prepared and happy to vote for a qualified candidate such as Lydia York. But as I am reminded that when Tip O’Neill thanked a nun for voting for him the first time he ran for office she said “Oh, I didn’t vote for you Thomas, people liked to be asked!”. Ms. York hasn’t asked.

    • She’s scheduled to campaign at a big local event–10K plus people on average–this weekend. Arden Fair.

      If she’s a no-show, I’m done campaigning for her. I’ve been e-mailing everyone I know to get them out to vote for her.

      Time for her to ask for their votes on her own.

    I’m starting to think Lydia York is part of the plan to keep KMG in office — run a “challenger” who does nothing except head off any real challengers.

      Lots of merit to this reasoning, but it leaves one to wonder whether Lydia York has no shame. Having to go through life with a badge that reads “I lost a primary to a convicted misdemeanant” is hardly a career builder.

      I met York while she was out campaigning and she is sincere. She is serious and would be a great auditor.

        You may think she’s sincere, but many of us don’t think she’s been out enough to show the people that quality and whatever other fine qualities she may have. If she’s counting on the party organization to pull her through, she may be making a major miscalculation.
        I think Lydia would make a fine auditor, but first she has to be a fine candidate, and too few people have seen that, and the primary is only 12 days away.

    While the state can and should do better than York, it’s a total indictment on the voting public and Dems if they allow a convicted incumbent back in that seat. The proverbial ham sandwich SHOULD be the more logical choice.

    Now, can we finally get serious about an inspector general?

      It’s a primary so the “voting public” is the Dem establishment. Can the Party just phone it in and still get York elected? We’ll see.

      The position only pays (I think) around $120k. That is far below what someone with the skillset to do the job would command in the private sector. So you get three types of people interested; a competent public servant willing to make a sacrifice, a politician looking for statewide recognition and people who fundamentally do not understand what the job entails. The state poobahs are not enthusiastic about the first type. Everyone in power is just fine with a do-nothing state auditor.
      The issue I have with an appointed IG is this; an elected AOA runs the risk of a political hack getting in, an appointed IG guarantees it.
