Because the State of Emergency is narrowly tailored to apply only to drivers of vehicles and not to businesses. Responsible businesses will not force their employees to break the law and drive to work. But there are plenty of irresponsible businesses out there.
DD, I’m curious if next time, (and let’s hope there’s not a next time) if Markell will change the wording of the SEO driving ban to penalize businesses that may require their employees to come in to work. Down in our neck of the woods, WBOC was filming idiots yesterday afternoon trying to get to the Seaford Walmart to shop.
So they just deploy the police to stop people and hand out tickets. Which they were definitely doing both in NCCo and in Wilmington. So you get to choose whether to bust your butt to get to work or to risk the ticket. Nice choice.
And cassandra, I think that’s the point. As someone who worked retail many moons ago, that’s the choice we (as employees) were given. If the Dover Mall (or at least 2 or the 4 “anchors”) decided they were either staying open or opening, smaller stores had to open (or stay open) or risk a fine from the Mall. I’m sure Christiana Mall has the same sort of arrangement in place in its leases. The skeptical part of me believes that either the Christiana Mall knew the state was dropping the driving ban in NCC or the State know that the Mall was going to open and decided to lift the ban. Since I don’t live upstate, I have no idea if its really safe enough to drive or not. I’m just glad I have a son and Stepdaughter so bored right now that the entire driveway is clear down to blacktop 🙂 So as soon as the Kent County ban is lifted, I can go somewhere if I want 🙂
Great video. I shot one of ours too, but pictures just didn’t do it justice.
Hey DD, lawyery type of question for you.
If Delaware is under a state of emergency, how can stores and businesses be open and force their people to come to work?
Good question nemski. I was wondering that myself. My business decided to close the site for the day since the SOE hadn’t been lifted by 10 AM.

I doubt that will happen. Such a move will be deemed anti-business no matter how reasonable and responsible it is.
