DOVER, Del. – A Delaware judge has chastised prosecutors for failing to turn over information to the defense in a criminal corruption case against State Auditor Kathy McGuiness, issuing a ruling that also exposed weaknesses in the state’s cyber forensic capabilities.

In a ruling on Wednesday, Superior Court Judge William Carpenter Jr. prohibited prosecutors from using material from three laptops that were seized during a search of McGuiness’ officer in September 2021. Carpenter said that prohibition was an appropriate sanction for prosecutors’ failure to provide information contained on laptops to the defense until April 6th, more than six months after the search.

However, Carpenter refused to grant a defense motion to dismiss the indictment against McGuiness.

I suppose the one good thing you can say about Republicans is that they are utterly transparent. There is no pretense or shiftiness. At this point, you’d have to be a Chris Coons to not see the “1+1=2” political calculus at the heart of the “Let’s allow babies to starve to hurt Joe Biden” strategy.

It’s a populist working class party now:

House GOP leaders were among the 192 Republicans who voted against providing $28 million in aid to the Food and Drug Administration to address the shortage of baby formula — within days of criticizing President Biden for not doing enough on the issue.

House Minority Leader Kevin McCarthy (Calif.), Whip Steve Scalise (La.) and Conference Chair Elise Stefanik (N.Y.) voted late Wednesday against the measure to provide new FDA funding, which the House approved on a largely party-line vote of 231 to 192. Twelve Republicans broke ranks and joined with Democrats in backing the money.

Barney Frank’s dictum that for Republicans life begins at conception and ends at birth is one of the most enduring truths ever spoken.

Biden’s Passive Voice Chickenshit Malarkey

Biden still refuses to call out the racist white supremacists currently running the Republican Party by name. Why? Some vain hope that “the good Republicans” will reassert themselves?  Fear of losing the 250 “centrist” voters who don’t like confrontation?  Give me a fucking break.

In his Buffalo speech, Biden declared, “Hate will not prevail.” He described “a hate that through the media and politics, the internet, has radicalized angry, alienated, lost, and isolated individuals into falsely believing that they will be replaced.” And he warned, “The American experiment in democracy is in a danger like it hasn’t been in my lifetime … Hate and fear are being given too much oxygen by those who pretend to love America but who don’t understand America.”

Too much of this was in the passive voice. Those who pretend? Why didn’t Biden name names?

Karine Jean-Pierre, the new White House press secretary, told reporters traveling with the president that Biden did not want to elevate those people by identifying them. “The people who spread this filth know who they are,” she said.

Sorry, but that is wimping out. This is no time for cowardly lions. There is still a fundamental decency to most Americans that needs to be reawakened. In that respect, moral leadership is also good politics.

Biden should be naming not just those like Matt Gaetz or Elise Stefanik who explicitly espouse these hatreds, but those in the Republican leadership from Trump, Mitch McConnell, and Kevin McCarthy on down who refuse to break with the explicit haters.

After the Buffalo killings, Liz Cheney tweeted: “The House GOP leadership has enabled white nationalism, white supremacy, and anti-semitism. History has taught us that what begins with words ends in far worse. @GOP leaders must renounce and reject these views and those who hold them.”

Biden is the president. He should display at least the gumption and moral clarity of Liz Cheney.

Republican kills 10 in Buffalo shooting attack

A gunman embracing Republican ideology opened fire yesterday afternoon at a supermarket in a predominantly Black neighborhood of Buffalo, killing 10 people and wounding three more. The mass shooting was the deadliest in the United States this year and among a spate of racist attacks in recent years.

The suspect, Payton S. Gendron, 18, had driven more than 200 miles to stage the attack, and he livestreamed it as he fired at shoppers and store employees. He was arrested at the store and pleaded not guilty in a brief court appearance.

Around the same time, a manifesto attributed to him appeared online, repeatedly invoking the Republican Party’s talking point that white Americans were at risk of being replaced by people of color. The view is known as “replacement theory” and was once linked to the far-right fringe, but it has become increasingly mainstream.

Delaware State University To File Complaint With DOJ Office of Civil Rights Over Liberty County Sheriff’s Office About Lacrosse Team Traffic Stop Turned Search


DELAWARE– Body camera video from one deputy shows many details about the traffic stop turned search.

Delaware State University President Dr. Tony Allen says the video makes the university’s case stronger as it pursues a federal lawsuit. But it may not stop at just one complaint.

“We’re also looking to create more avenues if they so choose to file their own suits on this matter,” Dr. Allen said. “We believe the complaint will help connect in that regard because it relates to evidentiary findings that we have already introduced.”

He also says that while there was no worry for safety and privacy of teams traveling before this, there will be going forward.

“No student, no staff, no coach should have to worry about inappropriate stops and searches as they are traveling,” Dr. Allen said. “So we will be sure that we continue to think through everything we can possibly do and continue to do moving forward to guarantee their safety.”

Four deputies responded to the traffic stop that day. There was a Freedom of Information Act request submitted by DSU to receive the other three body camera videos. That request has expired with no response. It will be submitted again.

Dr. Allen says that his conversation with Sheriff William Bowman was cordial but there is still a lot of disagreement.

“The impasse is apparent,” Dr. Allen said. “We believe the stop and search raises serious constitutional and civil rights issues. He disagrees. It is worth noting here that he ordered the release of body camera footage from one of the four officers involved in the incident, which he believes exonerates his department.”

This WRDE coverage says it is a “federal lawsuit” which isn’t accurate, per Steve Newtons FB comments.
