Judge throws out PUMA challenge to Obama qualifications to be President.
In a 34-page memorandum and opinion, the judge said Berg’s allegations of harm were “too vague and too attenuated” to confer standing on him or any other voters.
Surrick ruled that Berg’s attempts to use certain laws to gain standing to pursue his claim that Obama was not a natural-born citizen were “frivolous and not worthy of discussion.”
The judge also said the harm Berg alleged did “not constitute an injury in fact” and Berg’s arguments to the contrary “ventured into the unreasonable.”
Rightwing blogs are probably looking into the kerning of the Judge’s document as we speak.
The wingnuts have had a bad few days. First they all champion that lying racist bitch who self mutilated herself in Pittsburgh, and thus made they all appear as the fools they are when she confessed her lie, and now this.
Why are they obsessed with Obama’s birth certificate? Don’t they know that McCain is the one who wasn’t born in the U.S.? He was born in Panama.
The Republicans are falling apart, it’s sort of like watching Jerry Springer because they’re airing all their dirty laundry as they do it.
I’m fascinated by the McCain/Palin rift. I wonder how it’s playing on the other side.
So, I see a Republican connection mentioned, but wasn’t this the DEMOCRATIC wingnut that was all pissy because Hillary wasn’t winning the nomination? Just asking.
Actually, RSmitty, the mention of PUMA in the post refers to the anti-Obama / Hillary Clinton supporters. Now, in my opinion, these Clinton supporters who have been spreading the very same lies about Obama that the wingnuts have been spreading were never Democrats or liberals at all. Dominique is a perfect example. The hate sites “Hillary is 44” and Larry Johnson’s “No Quarter” are others.
No, I think Smitty is right. I think Berg is one of the PUMAs, but some rightwing sites are obsessed with the birth certificate stories.
Berg is definitely a PUMA, but this birth certificate story was pushed pretty hard and kept alive in places like Red State, Atlas Shrugged and other right wing blogs. There was even a post over at Delaware Politics. If my email correspondents are correct, Rush Limbaugh joined in the fun in trying to bring this back. Outside of Larry Johnson and his tens of commenters, I think the PUMAs are functionally dead as a group.
You do not hear about the PUMAs much anymore. The last poll I saw had former Hillary supporters supporting Obama at the same rate as other Democrats >85%.

I had thought I put a de-bunk post about this fiasco (I had received the so-called controversy via chain-e-mail), as I have about other junk mails on Obama, but I can’t find it. Either I am totally loopy (very possible), or it didn’t survive the move from the old DP site to the current one (also very possible). Anyway, I wasn’t trying to stir anything up, just asking for clarification.
FWIW – I am glad this was tossed. It was so useless and so vindictive of a suit, that I had actually forgotten about it until I read this post.
John McCain may have been born in the Canal Zone, but he was the son of two American citizens, one of whom was stationed in the Canal Zone under orders from the United States government; that makes him a natural-born citizen.
Whether Barack Hussein Obama is technically a natural-born citizen is a serious question, but one which really does not matter. Even though the Constitution requires that a person be a natural-born American citizen to become president, there is absolutely no enforcement mechanism provided; the Framers seemed to think that our government would be composed of honorable men, who would simply obey that restriction. If the members of the electoral college decided to vote for a seventeen year old Tibetian who spoke no English and had never been to the US, that person would become president, period. The only remedy would be impeachment and removal by the Congress.
All of this would have gone away months ago, had your candidate done something really radical like proved himself to be a natural-born citizen.
An interesting, completely hypothetical, question for my friends on the left. Let’s say that, somehow, absolute proof emerges in the next few days that Mr Obama is not a natural-born citizen. Would you then vote for John McCain, or perhaps a third party candidate, because your favored candidate would have been proved ineligible?
There won’t be definitive proof.
This is still a definitive smackdown of the birth certificate foolishness.
Besides providing each and every wingnut who are working at clapping harder at every single crazy conspiracy out there with their own personal notarized copy of the birth certificate, there is nothing you would believe anyway. For you, Obama must be shown to be illegitimate by any means necessary, and if a birth certificate will do it, you’ll take it. And this, my friends, is desperation writ very, very large.

Handled right, the Fed District Court throwing out Berg for lack of standing can present a political check-mate “win” on appeal for the anti-Obama side (if not in law, in the Court of Public Opinion). Here’s how: SIMPLY SPREAD AROUND OBAMA’S APPELLATE BRIEF HAVING TO ARGUE AGAINST AN AMERICAN VOTER’S RIGHT TO RAISE THE QUESTION UNDER THE CONSTITUTION. Should be a PR disaster for the Dems and Obama!!!
