    If a woman can get pregnant at 50 and wants to get pregnant at 50 then she should get pregnant at 50. Who are we to judge that decision?

    Sure…get your baby here anyway you want….but don’t ask for SS benefits, of your conceived child status post the sperm donor’s death–just because wife banked some for future use. I don’t have the magic wand DelDem and those other attorneys out there have to look up those family law cases–but it has happened. I’ll pay social security, but not eternity security.

    Case 1:

    Baby conceived without father’s consent (defective/misrepresented birth control, stolen sample at sperm bank, mixup at IVF clinic).

    Case 2:

    Baby conceived without mother’s consent (rape, defective/misrepresented birth control, mixup at IVF clinic).

    Case 3:

    Baby conceived after demise of one parent with full and signed consent prior to demise.

    Case 4:

    Baby conceived after demise of one parent without full and signed consent prior to demise.

    Which child gets benefits to 18?

    Please look at Case 2 again–a rape at an IVF clinic? No mother’s consent? What? Are they stealing us brood mares off the street now?

    all separate examples….

    Case 2:

    Rape – traditionally done without mother’s consent
    Defective/misrepresented birth control – bad tubal ligation (doctors have been sued for this)
    Mixup at IVF – one mother’s eggs fertilized and implanted in another, brought to term

    That is one for the government, though I do suspect the possibility of sarcasm so we will call that one for ‘You’.

  13. There are some doctor’s offices that won’t perform IVF on women over 50. There’s pretty much no limits now because one can use donor sperm, donor eggs and even donor uteruses. We can also turn the question around – should a couple over 50 be allowed to adopt a child? There may be some couples over 50 who are much healthier, wealthier and more involved than younger parents.
